    Jharkhand High Court acquits convicts of Chilkari massacre

    Ranchi, Dec 15: Jharkhand High Court today acquitted four main convicts of Chilkari massacre who were awarded the death sentence by a court in Giridih on June 23.


    A divison bench, comprising Justice R K Merathia and Justice D N Upadhaya, acquitted Jiten Marandi, Chhatrapati Mandal, Manoj Rajwar and Anil Ram due to lack of evidence.

    Earlier on June 23, Additional District and Sessions Judge(First) I D Mishra had ordered that all the four accused be hanged till death for perpetrating the massacre.

    MOGA CONVENTION AGAINST ATTACK ON DEMOCRATIC RIGHTS

    The Democratic Front Against Operation Green Hunt, Punjab held a well-attended convention at Moga on the International Human Rights Day i.e. 10th December. The convention held in the back-drop of killing of M. Koteswara Rao @ Kishenji - the CPI (Maoist) leader in an "encounter" mired in suspicion; death sentence awarded to Jatin Marandi-the peoples singer and theater-artist of Jharkhand; brutal & inhuman torture inflicted by Chhattisgarh Police on a tribal teacher, Soni Sori and a decade long fast by Irom Sharmila, the indomitable woman from Manipur, in protest against continuation of draconian Armed Forces Special Powers Act; was to focus on the significance of these events from the standpoint of human rights movement in the country and to chalk out its future direction.

    As a prelude to this convention, a press briefing was held at Desh Bhagat Yadgar Halkl Jalandhar on 4th December on these issues. The fact finding report prepared by the Coordination of Democratic Rights Organizations (CDRO), about the killing of Kishenji was translated and printed in Punjabi and widely circulated amongst democratic sections throughout Punjab.

    The convention venue, Shaheedi Park was decorated with flexes, banners and placards having photographs of Kishenji, Jatin Marandi & Irom Sharmila and slogans highlighting struggle and demands for protection of democratic rights.

    The Central Committee of the Communist Party of India (Maoist) has called a two-day nation-wide bandh from December 4 in protest against what it described as "the brutal murder" of the party's Polit Bureau member Koteshwara Rao alias Kishenji in an encounter involving joint security forces in Burisole forest in West Bengal's Paschim Medinipur district on November 24.

    A "protest week" will also be observed by the Maoists from November 29 to December 5 in this regard.

    CPI(Maoist) Central Committee spokesperson Abhay blamed Congress president and United Progressive Alliance chairperson Sonia Gandhi, Prime Minister Manmohan Singh, Home Minister P. Chidambaram and West Bengal Chief Minister Mamata Banerjee for the "murder."

    Meanwhile, Gudsa Usendi, spokesperson of the Dandakaranya Special Zonal Committee of the Communist Party of India (Maoist), said it would not be right to jump to any conclusion regarding allegations by a section of the media that Kishenji had been betrayed by his inner circle.

    Meanwhile, the preliminary reports of the autopsy conducted in Midnapore on Saturday before the body was handed over to Kishenji's niece Deepika Musthyala, reveal that there were six bullet injuries on his body and at least two shrapnel wounds.

    "We have not yet received the autopsy report and so cannot comment on it," said Gangeshwar Singh, Inspector-General of Police (Western Range).

    "He was tortured"

    Revolutionary poet and Maoist ideologue Varavara Rao insisted that Kishenji had been picked up a day or two before the "encounter," was tortured and then shot.

    Mr. Rao, who had seen the body in the mortuary at Midnapore Medical College and Hospital on Saturday, claimed that "the feet had been burnt... as if they had been held against an electric heater."

    Maoist rebels in India have called for a two-day-long countrywide strike in protest at the killing of top rebel Koteshwar Rao leader last week.

    The rebels say they will disrupt traffic and shut down businesses and educational institutions on 4 and 5 December, a spokesman told the BBC.

    They have already called for protests, saying Mr Rao was murdered in an orchestrated or "fake encounter".

    Mr Rao was one of the rebels' most senior leaders.

    The BBC's Salman Ravi says his death in police firing in West Bengal state last week was a major setback for the rebels.

    In a pre-recorded statement sent to the BBC, a spokesperson for Communist Party of India (Maoist), Abhay, said the shut down early next month would focus on paralysing movement of rail and road traffic apart from asking the educational and business establishments to remain closed.

    "Intelligence agencies and the security forces arrested Kishenji and killed him in cold blood after a day. They tried to show as if he was killed in an encounter," Abhay said.

    Police say Mr Rao was killed after a gun battle between rebels and paramilitary forces in the Burishol forest in the Jamboni area of the state's restive West Midnapur district.

    Mr Rao was cremated amid tight security on Sunday in his hometown of Peddapalli in southern Andhra Pradesh state.

    His death came during intensified anti-Maoist operations in West Bengal despite the fact that Chief Minister Mamata Banerjee has publicly advocated a negotiated solution through dialogue with the rebels.

    Mr Rao reportedly suffered temporary paralysis in June 2010 when a police bullet hit him in the knee.

    Normally a regular communicator with the press, little was heard of him from then until January 2011 when he issued a statement saying he expected India to succumb to a Maoist revolution by 2025.

    Latest estimates suggest he commanded at least 20,000 armed fighters. They are said to get most of their weapons by raiding police bases.

    The rebels have a strong presence in more than a third of India's 600 districts, and have been described by Prime Minister Manmohan Singh as the country's biggest security threat.

    A government offensive against the rebels - widely referred to as Operation Green Hunt - began in late 2009. That year the top Maoist leader and ideologue Kobad Ghandy was also arrested in Delhi.

    The Maoists are fighting for the introduction of a communist state and for what they say is a more egalitarian society.

    More than 6,000 people have died in the insurgency, which began in West Bengal in the late 1960s.

    Issues such as forcible eviction of people for land acquisition for projects, unsettled rehabilitation packages, degradation and unproductivity of land given to the poor have aggravated the Maoist menace in the Central and Eastern parts of India, Ramesh said.

    PUCL launches campaign against sedition law

    HIRUVANANTHAPURAM: Peoples Union of Civil Liberties ( PUCL) has launched a nationwide signature campaign against the Sedition Act whose provisions went sharply against the spirit of democracy, leading human rights campaigner Dr Binayak Sen said here.

    "We plan to collect one million signatures and present them before parliament during the winter session", Dr Sen said.

    He stated this while delivering the "D C Kizhekkemuri memorial lecture", organised in memory of freedom fighter, writer and founder of publishing house D C Books.

The banned outfit, known for its anti-national rhetoric and armed struggle against Indian government, has also demanded free and fair probe into all the terror attacks in the country since 1992 Babri Masjid demolition. The press release, available on a pro-Naxal blog, has been issued by spokesperson Abhay representing the central committee of the outfit.

    Maoist protest week hits life in Chhattisgarh interiors

    Raipur, July 4 (IANS) A protest week called by the outlawed Communist Party of India-Maoist (CPI-Maoist) began Monday in Chhattisgarh, hitting life in the state's vast forested interiors, police said. "The protest week has hit life in the interior pockets of Bastar's 40,000 sq km area where operators have kept buses and smaller passenger vehicles off the road fearing a Maoist attack," a senior officer at the police headquarters here told IANS. The official added that hundreds of police and paramilitary troopers have been relocated to strengthen security in the jungle areas vulnerable to attacks.

    500 army men to train in Chhattisgarh's red zone in a bid to injure Maoists' morale

    Raipur: Over 500 army personnel have arrived in the heart of a Maoist insurgency-hit area in Chhattisgarh's Bastar region for training, a move security experts say will psychologically hit the rebels.

    The contingent of the army's central command in Lucknow descended for the first time on the Maoist nerve centre of Abujhmad, around 300km from Raipur. Most of the area falls in Narayanpur district of Bastar.

    Naxal-selected mediators who held negotiation for safe release of R Vineel Krishna after his abduction by Maoists in February, today said violence may come down in Orissa if the state government honours agreement made during the hostage crisis.

    This was stated by Prof Hargopal at a convention here on implementation of 14-point pact between Orissa government and the mediators. Hargopal was one of the three mediators who played a key role in safe release of the then Malkangiri district collector and a junior engineer from Maoists.

    New Delhi, April 16: Sedition, a charge against Binayak Sen that the Supreme Court did not find merit in when the case came up yesterday, remains a harassment tool as it was 150 years ago when it was introduced by the British who have since abolished its use against their own citizens.

    Lala Lajpat Rai, Bal Gangadhar Tilak and Mahatma Gandhi spent varying terms in jail under Section 124A of the Indian Penal Code, promulgated in 1860 by Thomas Macaulay who is more famous for teaching Indians English.

    Convictions now are few and far between under the law, which minister Veerappa Moily has described as “outdated” while promising a “relook”.

    According to reports, the bullet fired by the ultras penetrated the chest of the deceased named Manoj Ojha, who was General Manager in Reliance Power, while Haren Buch, the Additional Vice-President of the same organization got severe bullet injury in his abdomen during the incident.

    Raipur, April 05, 2011:  On Wednesday, as the Supreme Court prepares to hear how Chattisgarh has shut down the Salwa Judum, the state-sponsored vigilante group and the state government have, for about two weeks now, closed all access to three remote villages where about 300 homes were burnt and an unknown number of women raped and men killed during a security operation.  Though the Chief Minister claimed otherwise, police and semi-official vigilante groups are stopping reporters and anyone outside the government from visiting the villages of Tadmetla, Timapuram and Morupalli in the tribal district of Dantewada in south Bastar, more than 550 km south of state capital Raipur.

    Supreme Court wants HC judge to probe Salwa Judum's attack on Swami Agnivesh

    Dhananjay Mahapatra, April 6, 2011, NEW DELHI: The Supreme Court on Wednesday took a critical view of social activist Swami Agnivesh being violently chased away by alleged Salwa Judum activists. The apex court felt a judicial inquiry by a high court judge would be proper.

    The court also questioned the Chhattisgarh government about mode and conditions of appointment of the armed group of special police officers - Koya Commandoes - for anti-Naxal operations and village protection.

    Chhattisgarh government opposes Binayak Sen’s bail

    Chhattisgarh government on Wednesday opposed the petition of rights activist Binayak Sen in the Supreme Court seeking bail and stay on his life term for his alleged links with Maoists saying he was involved in providing safe hideouts and logistic support to hardcore Naxalites.

    "He (Dr. Sen) provides active support and co-ordinates in spreading the base of CPI (Maoist) in the country. Apart from providing logistic support, he exchanges information and material directly and indirectly with the Naxalites in the area of Chhattisgarh, Bengal, Andhra Pradesh, Maharashtra, Bihar, Jharkhand and Orissa and propagates Naxal ideology," the affidavit filed by the State government said.

    Chhattisgarh government filed its affidavit through advocate Atul Jha in response to the notice issued to it on March 11 by the court on the petition by Dr. Sen challenging the rejection of his bail by the High Court on February 10.

    Supreme Court: "State can’t arm locals to fight Maoists"

    NEW DELHI, 6 APRIL: In what may be a precedent-setting example for the West Bengal government that has armed CPI-M party cadres to ostensibly take on the Maoists, the Supreme Court today disapproved the idea of arming local people to counter Maoists and sought an explanation from the Chhattisgarh government for creating an anti-Maoist armed group of special police officers ~ Koya Commandos.
    "What is this Koya Commandos? How are they appointed and how are they given training ? It is very dangerous.., giving them arms to fight," a Bench comprising Mr Justice B Sudershan Reddy and Mr Justice SS Nijjar said. The Bench directed the state government to file an affidavit on the raising of Koya Commandos and also state under what rule they were being supplied arms and ammunition. It posted the matter for further hearing on 15 April. "The affidavit will tell under which rule the Koya Commandos are appointed and under which rule they are given arms and ammunition? We must know it," the Bench said, while making it clear that the affidavit has to be filed by a senior officer.

    Don't go back on word, Maoist leader warns Naveen

    Maoist ideologue Ganti Prasadam has warned Chief Minister Naveen Patnaik against going back on his word to release 700-odd tribals lodged in various jails of Orissa.

    In a statement from jail, Prasadam (55) said it would be Naveen's great political folly if he "either intentionally or rather out of any compulsion from any quarter allows himself to be swayed by the disruptionist forces of different sorts who are bent upon destabilising the peace process and sabotaging the agreement reached".

    Is Kalpana asking too much? - UAPA marches on

    West Bengal police's Special Task Force (STF) claimed to arrest five persons including Sudip Chongdar alias Kanchan, State Secretary of CPI(Maoist), Kalpana Maiti alias Anu, wife of senior Maoist leader Anil Ghosh alias Akash, Barun Sur alias Bidyut, and Anil Ghosh alias Bijoy, all members of state committee. Arrested too is Shankar Mallick alias Buchu, said to be a Maoist linkman. This happened on December 3, 2010, though it is said that they were picked a week before by state police.

    All five, so far, have been produced in court four times for extension of police remand, which is now extended till December 31, 2010. This is the longest police remand, 30 days at a stretch, so far awarded to any person arrested under UAPA (Unlawful Activities Prevention Act). On all these days of Court production, all of them were brought hand tied and blind folded.

However they couldn't succeed and ultimately such a situation was defused and the Government of Odisha found itself in a situation to respond positively to the demands of the CPI (Maoist). In this process, the Government was at least understood for the time being not to wage war against the people by taking the name of Maoists.

    Two die in protest against proposed power plant

    Visakhapatnam: Two persons were killed and five injured when police opened fire to control villagers protesting against setting up of a thermal power plant in Andhra Pradesh's Srikakulam district on Monday.

    "Two persons were killed and five sustained injuries in the incident at Vadditandra village," said Srikakulam SP KVV Gopal Rao, adding some several policemen were also hurt.

    The situation at the project site where East Coast Energy Pvt Ltd is developing a 2,640 MW Super Critical Coal fired power project in Santhabommali Mandal continues to be tense for the past two days after the policemen disrupted the fast undertook by some fishermen and villagers on Saturday.
