Statement Condemning the Gagging and Harassment of Professor S A R Geelani, University of Delhi

Today at about 11.00 a.m. personnel of the Delhi Police Special Cell who claimed to be acting under the oral instructions of their superior officers, forced their way into Prof SAR Geelani's house, manhandled him and attempted to snatch his mobile phones. When Prof Geelani asked to see the written orders sanctioning this action, he was told that there were no written orders. The members of the Special Cell continued to occupy his residence and intimidate him and his family for five hours. They left his house only when journalists who learnt of this incident arrived at his residence. The Special Cell personnel have continued to loiter outside his house since then.

09/02/13 -- The CRPP condemns strongly the illegal execution of Mohd. Afzal Guru. The central home minister and the home secretary have gone on record saying that every procedure has been followed in the case of Afzal Guru. None of his family members are aware of this decision of the Government of India. Nor do the lawyers of Afzal Guru. It is mandatory on the side of the government to inform the petitioners who had filed the clemency petition. Afzal’s wife Tabassum had filed a clemency petition demanding justice for her husband who never throughout the trial got an opportunity to defend himself and demand justice.

From what appears in the news in Malayalam print media, about seven people were arrested by the Mavelikkara police from a lodge in the said town alleging them as Maoists. It seems they were all arrested in the afternoon of 29 December 2012 and till late night were not produced in the court. From the civil liberties fraternity it has been made clear that all the seven were remanded in police custody and they have been framed under the draconian UAPA. Even before the seven arrested could approach their lawyer the police have already started planting stories in the local print and electronic media saying that all the arrested have accepted that they belong to the Maoist organisations. Yet another usual story of fomenting rumours about the accused in the media so as to prejudice the courts towards buying the story of the police.

We, the undersigned, wish to express our shock and outrage at the secretive, unethical and blatantly inhuman murder by hanging of Afzal Guru, by the Indian State. This action was undertaken despite evident doubt in establishing Afzal Guru’s guilt in the Parliament Attack case. In fact, the honourable High Court had clearly stated that the evidence against Afzal Guru had been fabricated, and the honourable Supreme Court had stated that death sentence would be awarded to Afzal Guru only to satisfy the collective conscience of the nation.

The process of his arrest, trial, his sentencing by the lower court and the upholding of the death sentence by the Supreme Court, the rejection of his petition to the president, denial of his right to a judicial review of this rejection, and finally his secret hanging – all point towards the farcical nature of Indian judiciary and the complicity of the entire present political system in persecuting political dissidents.

Demand for the Total Abolishment of Death Penalty!

The execution of Ajmal Kasab in the most secretive manner befitting an assassin by the Indian state should be condemned by all sections that respect and stand for a polity that believes in deliberation, transparency and the finer values of humanity where the right to life becomes central. A section of the jingoist media and vested interests have celebrated this as justice to the victims of terror and in this hubris have highlighted capital punishment as the way out for all the evils that are holding back humanity. There is a definite competitive bidding at being the ultimate nationalist as the jingoists have asked for more blood in the form of capital punishment so that the ‘nation’ can be rest assured its pride of place by restoring justice. As we are optimists who understand that human nature can change and evolve for the better with the larger well being of the society committed to the values of compassion, sharing and equality, death penalty as a solution for the ills of the society is the ideology of the oppressor, the exploiter.
